Terms & Conditions
By registering and using the Boat Fix™ service, including certain proprietary software of Boat Fix (the
“Service”), you agree to these terms and conditions (“Terms”).
These Terms are in addition to the written service agreement between you or your organization and Boat Fix LLC
(the “Service Agreement”), which is incorporated by reference.
If there is any conflict between these Terms and the Service Agreement, the Service Agreement shall control.
The Service Agreement must be in effect to use the Service.
Boat Fix may modify the Service and/or these Terms at any time and without prior notice. ALL COMMUNICATIONS
TRANSMITTED THROUGH THE SERVICE MAY BE MONITORED FOR QUALITY ASSURANCE, TRAINING, AND OTHER PURPOSES. BY
ACCEPTING THESE TERMS, YOU CONSENT TO ANY SUCH MONITORING.
1) Definitions
Account means your registered account used to access the Service.
Action Plan means the predetermined plan of action in the event of an incident occurring aboard the applicable boating vessel on which the Boat Fix Device is installed.
Boat Fix Device refers to any and all hardware sold by or distributed through the Service Provider for use with the Service (including consumer purchases, rentals, or marina deployments, and insurance program installations) and any embedded or associated SIM card, whether used collectively or individually, as the context requires.
Boat Fix System means, collectively, the servers and other hardware and infrastructure through which the Service is provided.
Contract Period means the period during which the End User has subscribed and paid to use the Service as set forth in the Service Agreement.
Distributor means any representative of Service Provider which is authorized by Service Provider to distribute Boat Fix Devices. The Service Provider’s initial distributor in the U.S.A. is Boat Fix, located at 133 Brookview Ave, Fairfield, CT 06825, U.S.A.
Early Termination Fee means the fee charged if the End User terminates the Service Agreement prior to the expiration of the then-effective Contract Period.
Insurance Partners means insurance carriers and marine insurance brokers with whom Boat Fix works for eligible programs (e.g. underwriting, discounts, claims support).
Network means the public telecommunications system through which the Boat Fix Service is made available.
Service Charge means the fees paid or payable by End User for the Service during the Contract Period as set forth in the Service Agreement.
SIM means the subscriber identity module embedded in or associated with a Boat Fix Device.
Vessel/Telematics Data means device status, alerts, operating hours, diagnostics, and approximate or precise location (if enabled).

2) Scope of Service
The Service includes, as applicable, cellular (GSM) connectivity between a Boat Fix Device and the Boat Fix Systems, the Boat Fix mobile and web applications, notifications (e.g., text (SMS), email, or push), analytics, support, and device firmware and software updates. Certain features require an active subscription and compatible hardware, software, and connectivity.
3) Device and SIM Ownership; Right to Use; Returns/Disablement
Ownership; Right to Use. For all customers, including consumer (B2C) purchases, rental or marina deployments, and insurance program installations, the Boat Fix Device remains the property of Boat Fix, LLC. You are granted a limited, non-exclusive, non-transferable right to use the Device solely during the active Service Period and only with the Service. No title to the Device passes to you.
SIM Ownership. The SIM embedded in or associated with the Device remains the property of Boat Fix, LLC at all times. You must not remove the SIM, use it with non-Boat-Fix equipment or networks, resell, transfer, or tamper with it.
Expected Lifecycle; Return/Disablement. Boat Fix does not generally request the return of Devices once the expected service period has ended (typically three (3) to five (5) years). However, Boat Fix reserves the right, in its discretion, to require the return or to remotely disable any Device at any time, including in cases of early termination, breach of the Service Agreement, non-payment, suspected fraud, security concerns, or misuse of the Device or Service. If return is requested, you must return the Device (including the SIM) within 30 days in good working order (ordinary wear permitted). Boat Fix may assess applicable return, replacement, or non-return fees.
Care; Prohibited Uses. You agree to use the Device and SIM lawfully and in accordance with documentation, and not to: sell, loan, or transfer them; reverse engineer, decompile, tamper with, or circumvent security; or use the SIM with non-Boat-Fix equipment or networks. Boat Fix may push updates or manage/deactivate a Device/SIM to protect users, networks, and the Service.
Your Responsibilities. You are responsible for (a) providing accurate registration and billing information; (b) maintaining the confidentiality of your Account credentials; (c) complying with laws and safe boating practices; and (d) all activity under your Account. You are responsible for any third-party charges (e.g., internet or mobile data used by apps).
4) Service Availability
The cellular (GSM) service is available both domestically within the U.S.A. and internationally. All cellular (GSM) communication between the Boat Fix Device and the Boat Fix System is included in the Service Charge. The End User acknowledges that availability may be affected by factors outside the Service Provider’s control (e.g., physical obstructions, internet availability, routing, atmospheric conditions, interference, and faults in other networks). The Service Provider incurs no liability for such effects, and the End User remains liable for payment during the Contract Period.
5) Contract Period
Each Service Agreement has a defined Contract Period. The End User agrees the Service may not be suspended or cancelled for 12 months following commencement and will continue to pay the Service Charge for a minimum of 12 months from commencement.
6) Use of the Built-in SIM Card
The Device has a built-in SIM card, title to which belongs to the Service Provider. The Service Provider may cancel the Service and permanently terminate the SIM if: (i) the End User fails to pay any Service Charge; (ii) the Service remains unused and the service agreement is not renewed or terminated after three (3) months post-Contract Period; or (iii) the SIM is abused or removed.
If cancelled, the Device may be sent for a replacement SIM. A minimum fee of US$100.00 applies per replacement. If the Device and/or SIM are lost or stolen, notify the Service Provider immediately. Until notification is received, the End User is liable for charges incurred.
7) Service Charges
End User must pay Service Charges promptly during the Contract Period. Charges are automatically billed to the End User’s credit card on the monthly or annual anniversary of the Service Contract. Failure to pay may result in limitation or termination and liability for the Early Termination Fee. Prices and terms may be adjusted with at least one (1) month’s notice.
8) Early Termination Fee
The Service Agreement may be terminated before the Contract Period expires upon payment of the Early Termination Fee.
9) Automatic Continuation of Service Contract
After the initial Contract Period, the End User may continue using the Service until terminated in writing. A monthly Service Charge will continue to be due for one (1) full month following the date termination notice is given.
10) Termination of Contract
After the Contract Period, the End User may terminate by written notice (U.S. mail, email, or fax). Termination becomes effective one (1) month after the first day of the month immediately following receipt of notice. Service Provider may suspend/terminate Accounts for any reason, which may result in deactivation or deletion of the Account and forfeiture of Your Data.
11) Limitation of Liabilities
a. Service Provider is not liable for theft or damages resulting from Service unavailability; End User is responsible for acting on notifications and keeping action plans current.
b–h. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES; LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW, including caps on damages as described in the original text provided.
12) Account Registration and Terms
Requirements for creating and maintaining an Account; age restrictions; accuracy of information; security obligations; responsibilities for Your Data; prohibited uses; and Privacy Policy reference, all as set forth in the original text provided.
13) Limitations of Use
Restrictions related to trademarks, proprietary rights, reverse engineering, copying, sublicensing, derivative works, competing use, and confidentiality, as set forth in the original text provided.
14) Materials and Content
Ownership and permitted display of Materials, restrictions on modification/distribution, third-party content disclaimers, linking policy, and IP compliance requirements, as set forth in the original text provided.
15) Your Warranty and Indemnification
You agree to defend, indemnify and hold harmless Boat Fix and its affiliates as set forth in the original text provided.
16) Your Use of Third-Party Applications
If you use third-party apps with the Service, Your Data may be shared with those apps under their terms and privacy policies. Boat Fix is not responsible for third-party services.
17) Security
Industry-standard technical and organizational measures will be used to protect Your Data as described in the original text provided.
18) General Conditions
Backups; rights to process/transmit Your Data (including sharing with Insurance Partners as specified); use of third-party vendors; waiver; export controls; equitable relief; governing law and jurisdiction (Connecticut, with special rules for certain non-U.S. users); disclosures to authorities; severability; assignment; third-party beneficiaries; successors and assigns — all as set forth in the original text provided.

This notice describes the Privacy Policy for www.boatfix.com (the “Website”) operated by Boat Fix, Inc., a Connecticut limited liability company (the “Company”, “we” or “us”). By visiting the Website, you accept the practices described here, which are also part of the Website Terms of Use.
1) Data Acquisition
a) Information You Give Us. We receive and store information you enter or give us in other ways (e.g., name, address, email, birth date, phone, payment info, demographics). May be shared with business partners to offer products/services or promotions.
b) Automatic Information. We store certain info when you interact with the Website (e.g., pages visited, cookies, device/telematics/diagnostics including connectivity and approximate/precise location if enabled). We may use cookies and work with partners for analytics and, where allowed, interest-based advertising.
c) Email Communications. We may store email correspondence to improve experiences and send updates.
d) Blog/Testimonials. Public areas may expose posted info to others; contact us to request removals where possible. The Services are not directed to children under 13.
2) How We Use Information
To operate and improve the Website/Services; fulfill requests; account notices; billing; direct marketing and research; and other disclosed purposes. For AI usage: only aggregated, anonymized telemetry/diagnostics/interaction trends are used for model training; PII and identifiable records are not used for AI training. We do not sell personal information.
3) Disclosure of Information
We share personal information as described: with subsidiaries/affiliates; contractors/service providers (under confidentiality and purpose limitations); in corporate transactions (with notice); with Insurance Partners for underwriting, servicing, risk, discounts, eligibility, claims, and fraud prevention (de-identified where feasible, limited and safeguarded when identifiable), and as legally required or to protect rights/safety. We do not sell personal information.
4) Access and Choice
Request deletion or correction via the contact information below. We will respond within a reasonable timeframe. Retention as necessary to comply with legal obligations, resolve disputes, and enforce agreements. Manage Insurance Partner participation/sharing by contacting us.
5) Public Areas of the Website
Open public forums may expose your information to others.
6) Data Security
We implement administrative, physical, and technical safeguards, and strive to encrypt transmission via SSL. No system is 100% secure; use strong passwords and caution in public areas.
7) Third-Party Websites, Widgets & Social Features
We are not responsible for third-party sites or their privacy practices. Social features and Open ID may collect data per their own policies.
8) Children Under the Age of 13
We do not knowingly collect personal information from children under 13; if discovered, we will delete it.
9) Data Retention
We retain information while your account is active and as needed for the purposes described or as required by law. You can request deletion, subject to technical/legal limits described in the original text provided.
10) Mobile Privacy
Mobile access may involve location services and device identifiers. You can typically disable location in device settings. We do not use this information for advertising nor provide it to third parties for marketing.
11) Changes to This Policy
We post changes on this page. Continued use after changes constitutes acceptance.
